Peace River 2019 Field Trip: Release and Indemnity Agreement


I, in consideration of the receipt by me of permission from the Southeastern Geological Society and their affiliates (hereinafter “Hosts”) to participate in a field trip entitled Peace River Fossil Trip to be conducted on November 23, 2019 , and sponsored by Hosts, the receipt of such permission being hereby acknowledged, and being fully aware that the Field Trip may involve hazardous and/or dangerous activities, and/or be in a location in and/or around other hazardous and dangerous conditions, and recognizing and accepting the risks, known and unknown, involved in a Field Trip, hereby release and will indemnify, defend and hold harmless Hosts agents, officers, and Volunteers of Hosts, and the leader or leaders of the Field Trip (collectively referred to as “Indemnitees”) of and from any and all liabilities, claims, demands, actions, and causes of action whatsoever arising out of or relating to any loss, damage, or injury, including death, as may be sustained by me, and to any loss, damage, or injury to any property of mine, while involved in any way with the Field Trip, including without limitation traveling to and from the site or sites of the Field Trip (whether by air, water, or land transportation) and at and during all stops and layovers during the Field Trip.

This release and indemnity includes without limitation liabilities, claims, demands, actions, and causes of action to or by third parties as well as to or by me. This release and indemnity includes without limitation liabilities, claims, demands, actions, and causes of action arising out of or relating to any loss, damage, or injury caused in any way by the concurrent or contributory negligence of any indemnitee. This release and indemnity includes without limitation liabilities, claims, demands, actions, and causes of action arising out of or relating to any loss, damage, or injury caused in any way by the sole negligence of any indemnitee. Having made all inquiries deemed by me to be appropriate, I hereby voluntarily assume all risks of loss, damage, or injury, including death, as may be sustained by me or any property of mine while involved in any way with the Field Trip.

In the event the release by me of any indemnitee of any liability, claim, demand, action, or cause of action described herein is determined to be invalid or unenforceable, I agree that my total recovery of damages from the Indemnitees, or any of them, both actual and punitive, shall be limited to $100.00 or the cost of admission to the Field Trip, whichever is less.

Execution of this release and indemnification agreement constitutes agreement that photographs or recordings of field trip and/or associated meeting activities may be published in Hosts newsletters, publications, and websites without credit or compensation to the photographer and without compensation, credit, or further approval of field trip/meeting participants.

Additionally, I agree to adhere to the following safety guidelines.

Guidelines for Participants:

  1. I will completely fill out registration forms and always provide the names of other attendees (i.e. spouse and, if allowed, children along with children’s ages).
  2. I will have required liability waivers completely filled out, signed, and notarized (as required) before arriving at the rendezvous point.
  3. I will inform field trip leader of any serious physical limitations or health problems prior to registering for a field trip.
  4. I affirm that I understand that participation in club field trips involves inherent risks that may include – among others – sun exposure, inclement weather, biting/stinging insects, unstable footing, steep slopes, soft ground, and sharp rocks/fossils.
  5. I will obey all rules set by property owner(s), MSHA, OSHA, and field trip leader(s). For example, I shall not stand on the edge of a quarry wall, climb to the top of spoil pile, climb on excavating equipment, or wander off by myself.
  6. I will obey all applicable local, state, and federal laws at all times.
  7. I will dress appropriately for the type of field trip (boots, hat, long sleeves, and long pants are appropriate).
  8. I will bring and wear proper safety equipment (i.e., safety glasses, hard hat, safety vest, life preserver).
  9. I will bring and apply sunscreen and insect repellent.
  10. I will drink plenty of fluids and stay hydrated.
  11. I will pay attention to the weather.
  12. I will return to the vehicles at the predesignated times.
  13. I will always ride in my assigned vehicle. I will never switch vehicles without notifying field trip leader.
  14. I will look out for the safety of my fellow field trip participants.
  15. I will never dump materials from other collecting spots (this contaminates the site with material from different ages/formations).
  16. I will always remove trash that I or my group generates, and I will remove trash that others may have left behind.

Guidelines for Drivers:

  1. I will ensure that I have documents required by law, including license, registration and insurance.
  2. I will obey all applicable local, state, and federal laws at all times.
  3. Before the caravan departs, I will possess cell phone numbers of field trip leader(s).  If I need to report a problem (e.g. traffic issues, flat tire, ill passenger), I will call the cell phone(s) of the field trip leader(s).
  4. I will designate a navigator and communicator who is familiar with operation of my cell phone. I will not operate my cell phone while driving.
  5. Before the trip, I will ensure that I have enough fuel to operate my vehicle until the end of the field trip. I will coordinate with the field trip leader if I need to stop to refuel.
  6. I will ensure that I have directions to each field trip stop.
  7. I acknowledge that participants who know the field trip route should be in the first and last vehicles in convoy. If I am aware that someone’s vehicle has a breakdown or other problems, I will ensure that they are not be left behind.
  8. I will ensure that my vehicle has all its passengers before leaving each stop. I will ensure that no one is left behind.
  9. I will never leave the field site earlier than the rest of group, without first clearing the departure with the field trip leader.
  10. I acknowledge that, except under emergency conditions, vehicles in the caravan should never pass another vehicle in the caravan.
  11. I acknowledge that, when traveling, all vehicles are to maintain reasonable spacing. I will not speed or tailgate. 
  12. I will require that all passengers, including myself, fasten their seat belts. 
  13. I will operate my vehicle in a safe manner at all times.

In the event any provision of this Release and Indemnity Agreement is determined to be invalid or unenforceable, all other provisions hereof shall continue to be enforceable and shall be interpreted as though said invalid provision had never been contained herein.

This release shall be binding upon my distributees, heirs, next of kin, executors, administrators, and personal representatives.

NOTICE TO THE MINOR CHILD’S
NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE SOUTHEASTERN GEOLOGICAL SOCIETY AND THEIR AFFILIATES USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE SOUTHEASTERN GEOLOGICAL SOCIETY AND THEIR AFFILIATES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE SOUTHEASTERN GEOLOGICAL SOCIETY AND THEIR AFFILIATES HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

IN SIGNING THIS RELEASE AND INDEMNITY AGREEMENT, I HEREBY ACKNOWLEDGE AND REPRESENT THAT I HAVE READ THE FOREGOING RELEASE AND INDEMNITY AGREEMENT, UNDERSTAND IT, AND I HAVE SIGNED IT VOLUNTARILY. I UNDERSTAND AND AGREE THAT I WOULD NOT BE ALLOWED TO PARTICIPATE IN THE FIELD TRIP IF THIS RELEASE AND INDEMNITY AGREEMENT WERE NOT SIGNED AND AGREED TO BY ME, AND THAT THE AGREEMENT BY ME TO THE TERMS AND CONDITIONS OF THIS RELEASE AND INDEMNITY AGREEMENT IS AN ESSENTIAL PART OF THE CONSIDERATION FROM ME FOR ME TO BE ALLOWED TO PARTICIPATE IN THE FIELD TRIP.
